Terms of Service

1. Terms' nature and applicability

1.1. The following terms and conditions form an agreement (hereinafter referred to as the "Agreement") between the user (hereinafter referred to as "You") and RAD Trainers and Consultants ("Unifees", "We", or "Us"), the operator of www.studyunifees.io (the "Site") and related applications, services, and mobile applications provided by Unifees (hereinafter referred to as "Unifees This Agreement applies to both registered and non-registered users of the Services (defined below).

1.2.By using or otherwise accessing the Services and/or registering with Unifees, you agree to be bound by the provisions of this Agreement, including the information set out below. You should not use the Services if you disagree with this Agreement. Unifees has the right to refuse you access to any of our Platforms.

1.3.Unifees maintains the right to change, substitute, alter, or discontinue any of its services at any time. Such information will be included in the terms and conditions when updated, and it is your responsibility to stay informed about such changes. Following such posting, your continued use of the Site and/or the Services constitutes your affirmative acknowledgement of the Terms of Use or other applicable Agreement documents, the modification, and agreement to abide and be bound by the Terms of Use or other relevant Agreement documents, as amended.

1.4.It is solely your responsibility to keep yourself informed about changes to the Terms of Service and Privacy Policy. If You do not agree to these terms of use at any time, including any subsequent amendments, You must cease visiting Unifees Platforms and using the Services.

1.5.You agree that Unifees will not be responsible to You or any other party if any services or portions thereof are suspended or discontinued. The collection, use, and sharing of your data as a Visitor or Member of our Services is governed by this Privacy Policy and its modifications.

2. Visitors and Members

Once you've utilized our services, we may gather some information from you that might be deemed personal or private for you to get the most out of them. You will be classified as a Visitor or a Member based on the type and volume of information collected. Do not use the Unifees Platforms/Services if you do not want to disclose such information.

3. Eligibility

To register on our Platform and use the Services, you must be legal age. Suppose You do not qualify under these criteria. In that case, You represent and warrant that You have the right, authorization, and ability to enter into these Terms of Use and abide by all of the terms and conditions set out herein by utilizing Unifees Platforms and/or Services.

3.1. Notwithstanding the above, anybody over the age of 12 shall be permitted to register on the Platform under the person's legal guardian who authorizes the registration.

3.2. If you are opening an account or using the Services on behalf of someone other than yourself, you represent and warrant that you have been allowed by that person or entity to accept this Agreement on their behalf.

4. Legal Compliance

4.1. This Agreement complies with all applicable laws, rules, and regulations, including but not limited to the Indian Contract Act, 1872; the Information Technology Act, 2000; and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (hereinafter referred to as the "SPI Rules"), and the Information Technology (Intermediaries Guidelines) Rules, 2011 (hereinafter referred to as the "IG Rules").

5. Defined terms

5.1."Applicable Law" refers to any domestic or foreign law, rule, statute, subordinate legislation, regulation, by-law, order, ordinance, protocol, code, guideline, treaty, policy, notice, direction, or judicial, arbitral, administrative, ministerial, or departmental judgement, award, decree, treaty, directive, or other requirement or guideline published or in force at any time during the Term that applies to or is otherwise intended to govern or regulate any person (includes any party), any rule, order, decision, directive, or other requirement or guideline issued by any Governmental or Regulatory Authority; any property, transaction, activity, event, or another item;

5.2."User" refers to any person, institution, organization, or other entity that has registered with the Unifees Platforms;

5.3."Services" refers to all of the Unifees Platforms' services. Text, data, graphics, images, photographs, video, audio, information, suggestions, guidance, and other materials provided, made available, or otherwise found through the Services or on any of the Unifees Platforms are subject to change at Unifees' sole discretion;

5.4."Our Content" means text, data, graphics, images, photographs, video, audio, information, suggestions, guidance, and other materials provided, made available, or otherwise found through the Services or on any of the Unifees Platform

5.5."User Anything" refers to content that Unifees posts on the User's behalf on Unifees Platforms, as well as information that the User makes available to other Users on the Site.

5.6."Posted Information" includes, but is not limited to, inquiries about educational courses, details of educational institutions, details of prospective students, career information, information on prospective jobs, and other content posted by the User personally or on their profiles to participate in the Site's other interactive and community features.

5.7."You" may relate to the above-mentioned User.

6. Relationship

Nothing in this Agreement will be considered to constitute or suggest a joint venture, partnership, principal agent, or employment relationship between the Parties, and each Party shall fulfil its responsibilities as an independent contractor. You will not act or claim to act as Unifees' legal agent, enter into any arrangement on behalf of Unifees, or otherwise bind or purport to bind Unifees in any way except as specifically allowed by Unifees in this Agreement.

7. Collaborate

Our Services enable communications and information exchange in a variety of ways, including your profile, articles, group posts, links to news items, job advertisements, and messages, among others. Other Members, Visitors, and others may view the information and material that you publish or upload (including off of the Services). We are under no obligation to publish any information or content on our Service, and we reserve the right to delete it at any time.

8. User’s responsibilities

8.1.The User is not permitted to host, display, upload, download, change, publish, transmit, update, or distribute any information that -

  1. belonged to someone else and the User had no right access it;
  2. is severely hurtful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libellous, invading another's privacy, racist, racially, ethnically undesirable, insulting, referring or inciting money laundering or gambling, or otherwise prohibited in any way;
  3. harm kids in any way;
  4. infringes on any patent, trademark, copyright, or another kind of intellectual property;
  5. infringes on any currently in effect legislation;
  6. deceives or misleads the recipient as to the origin of such messages, or conveys any material that is extremely offensive or frightening;
  7. pretend to be someone else;
  8. includes software viruses or other computer code, files, or programmes that are designed to disrupt, damage, or limit the operation of any computer resource;
  9. endanger India's unity, integrity, defence, security, or sovereignty, cordial relations with other nations, or public order; or causes inducement to commit any cognizable offence; or insults any other nation.
  10. compromises the integrity and security of the Unifees Platforms or tries to compromise the integrity and security of the Unifees Platforms.

8.2.User must not use any of Unifees Platforms for any cause other than those stated.

8.3.The user must not provide any incomplete, incorrect, or inaccurate information on purpose.

8.4.User shall not communicate with other Users in an uninvited manner.

8.5.The User must not misuse the contents of the Site.

9. Rights to Intellectual Property

All intellectual property rights in the Services are reserved by Unifees. The Services' trademarks and logos are the property of their respective owners.

10. Indemnity

All intellectual property rights in the Services are reserved by Unifees. The Services' trademarks and logos are the property of their respective owners.

10.1. User agrees to indemnify and hold Unifees, its affiliates, officers, directors, employees, consultants, licensors, agents, and representatives harmless from any and all third-party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from User's access to or use of Service, violation of this Agreement, or infringement, or infringement by any other User of his/her/its account, of any intellectual property or another right. Unifees shall promptly notify You of any such claim, loss, liability, or demand, and you undertake to give us with reasonable assistance, at Your expense, in defending any such claim, loss, liability, damage, or cost, in addition to Your preceding responsibilities.

10.2. In no event will Unifees, or any of its directors, officers, employees, agents, or content or service providers be liable for any direct, indirect, special, incidental, consequential, exemplary, or punitive damages arising from, or directly or indirectly related to, the use of, or inability to use, the Site or the content, materials, and functions related to it, the Services, User's provision of information via the Webs, or any of their directors, officers, employees, agents, even if Unifees was advised of the possibility of such damages.

11. Assignment

11.1. Unifees may assign this contract at any time to any parent, subsidiary, or related firm, or as part of our company's sale too, merger with, or other transfer to another organisation.

11.2. You are not permitted to assign, transfer, or sublicense this Agreement to anyone else, and any effort to do so in violation of this section is invalid.

12. Liability Waiver

Unifees' relaxation, forbearance, or delay in enforcing or exercising any of the terms of this Agreement will not prejudice, affect, or restrict Unifees' rights, nor will it constitute a waiver by Unifees of any subsequent or continuing breach of any terms or conditions of this Agreement, unless in writing.

13. Severability

Suppose any term, covenant, or limitation in this Agreement is deemed unlawful, void, voidable, illegal, or otherwise unenforceable by any court or other competent authority, or if either party receives indications of the same from any relevant capable body. In that case, the rest of the terms, provisions, covenants, and restrictions set forth herein shall remain in full force and effect and shall not be affected, impaired, or invalidated in any way. The Parties hereto are free to amend that provision, covenant, or restriction reasonably to achieve the Parties' intention without illegality, or such provision may be severed from this Agreement at the Parties' discretion. The remaining terms of this Agreement will continue in full force and effect unless the Parties determine that the impact of such statement is to subvert the Parties' original intention.

14. Whole Agreement

This Agreement contains the Parties' full agreement and understanding with respect to Confidential Information, and it supersedes all prior agreements, understandings, or undertakings.

15. Supplementary Agreement

The Parties recognise that this Agreement must be read in conjunction with the Privacy Policy and any other contract they may have agreed into. In the event of a dispute, the contents of this Agreement shall prevail and supersede all other/supplementary agreements' conflicting sections.

16. Titles

The headers in this Agreement are included for reference and convenience only, and they should not be used to interpret any of the clauses or sections to which they refer. They are not a part of this Agreement and do not in any way restrict, define, characterise, change, interpret, or construe the meaning, scope, or intent of this Agreement or any of its terms and conditions.

17. Arbitration

17.1. Any disputes or conflicts between the Parties resulting from any provision of this Agreement may be brought to a solitary arbitrator. The arbitrator's decision will be final and binding on the parties. Unifees is responsible for appointing the arbitrator. Dehradun will be the location of the arbitration. The arbitration will take place in English. The arbitration procedures will be governed by the 1996 Arbitration and Conciliation Act provisions. The Sole Arbitrator will also decide on any disagreement over the legality of execution of this Agreement and any dispute over jurisdiction.

17.2. Unifees maintains the right to choose whether the Users profile will be temporarily or permanently disabled upon termination. Unifees has the right to enable the user to re-register or use the same account at its discretion.

18. Jurisdiction and applicable law

This Agreement shall be governed and interpreted in all respects in conformity with the laws of India. In relation to this Agreement, your use of the Website or Services, or the information to which it provides access, the courts in Bengaluru shall have exclusive jurisdiction. Users are responsible for complying with any local laws applicable to their use of the Services or the Site if they use them outside India.

19. Grievances

19.1. Any concerns should be sent to Unifees at contact@studyunifees.io by an aggrieved individual in writing or through email signed with an electronic signature.

19.2. Following inquiry, any concerns addressed to Unifees will be dealt with under applicable legislation.
